CONFIDENTIAL INFORMATION The term “confidential information” means any information or data that is found or is not in writing, IT or any other existing support or that could be invented in the future, which JUMOBEDS communicates or provides to the AGENCY, or of which they have access to either with or without the knowledge and / or consent of JUMBONLINE.

Thus, restricted but not limited, it is understood as confidential information: data base and prototypes created from the documents submitted, software, access codes to computer systems, information about users and / or clients, phone numbers, fax numbers, email addresses, location of offices, agencies, headquarters, computer programs, copies, routines, sources, functional and organic analyzes, Know-How, formulas, processes, ideas, inventions (patentable or not), financial data and development plans, strategies, contents of offers submitted and any other document, data or support material belonging to JUMBONLINE or that is available on their web site that the AGENCY could have access to.

In no event shall be considered confidential any information referring to:

• Any subject that appears in open literature or becomes public domain unless it has become such due to a breach of one of the parties.

• Any information or knowledge (Know-How) obtained from a third party.

• Disclosure required by Law.

• Disclosure of any information requested by Judges or Tribunals.

• Information referring to economic data or other that must be declared to the State, Local or Regional Government for tax, labor or government contracting requirements.


It is expressly prohibited to disclose totally or partially to third-parties, individuals or legal entities, of this relationship, all confidential information to which the AGENCY may access through the contracting and execution of its services.

• The AGENCY guarantees that its employees, customers, suppliers, subcontractors and others involved in the collaboration agreements between JUMBOTOURS and the AGENCY comply with the confidentiality obligations contained in this agreement.

• The AGENCY agrees to maintain such confidentiality obligations indefinitely, even after the finalization of the relationship between parties from the date of signature of this agreement.


If for reasons to supply the services requested by the client of the agency, the AGENCY has to access files containing personal data, JUMBONLINE and the AGENCY must ensure that it is legally possible in accordance with the applicable laws and / or any legislation that develops, add, or replace the "Regulation on the Protection of Personal Data" (hereafter RPDP).

• Any personal data that, in using this system the AGENCY may disclose to JUMBONLINE, it is understood that it has been obtained, processed and transmitted under the strict compliance of the RPDP.

• JUMBONLINE and the AGENCY confirm and guarantee that have implemented, technical and organizational measures to ensure the security of personal data and avoid its alteration, loss, treatment and / or unauthorized access, taking into account the state of technology, the nature of the data stored and the risks they are exposed to. • JUMBONLINE and the AGENCY, agree, in the case of accessing any personal data, to the following:

- To safeguard, through legally required security, technical and organizational measures to ensure the safety of the same, avoiding its alteration, loss, or unauthorized access in accordance with the state of technology in every moment, the nature of the data and the risks to which they are exposed to.

- To use or apply the data only for the performance of the agreed services.

- Not to communicate, even for the purposes of conservation, to others. Reproduce all or part of the information, results or relationships of the same.

- Ensure that the data is only handled by employees whose intervention is required for the service. There is the possibility that the information can be disclosed to third parties, provided that they maintain confidentiality in accordance with the provisions established in this document.

- Once the service has come to an end, it must be ensured that all sensitive information, as well as supports or documents must be destroyed or returned.

- JUMBONLINE may disclose information of agency client’s to third parties only for the purpose of completing clients’ reservation and for administration purposes. Any data collected in this way on the website will be transmitted in accordance with the provisions of the RPDP, to entities that are evolved in the contracting of the services required.
